What are Development Entitlements?

Development entitlements refer to the approvals a project must receive from the Planning Commission, Historic Preservation Commission, or Zoning Administrator, as required by the Planning Code. These approvals are essential before a project can proceed. Whether for new construction, modifications, or preservation work, they ensure compliance with city regulations and alignment with planning guidelines. Without these entitlements, a project cannot legally move forward to the building permit stage.

Real Estate Developments or projects that require entitlements

These are a few types of projects that require entitlements:

  • New Construction;
  • Any vertical addition of 7 feet or more;
  • Any horizontal addition of 10 feet or more;
  • Decks over 10 feet above grade or within the required rear yard;
  • All Formula Retail uses are subject to a Conditional Use Authorization;
  • Project that requires Conditional Use Authorization, Downtown Project Authorization, or a Variance.

What do you need to do to get entitlements for your project?

(1) First thing is to schedule a Pre-Application Meeting.

The Pre-Application (Pre-App) Community Outreach Process is required before submitting permits. Based on the feedback you get, you will know what you’ll need to submit next.

(2) Submit a Project Application

What happens at the Pre-Application meeting?

The Pre-Application includes the Community Outreach Process. The applicant may opt to have a Planning Department Facilitated Pre‐Application Meeting instead of a meeting on or proximate to the proposed project site. The meeting will be held at the Planning Department.

What do I need to provide?

Applicants should mail the pre-app notices and a copy of the plans (no smaller than 8.5”x 11”) to adjacent neighbors and neighborhood organizations. If no schematic plans exist for the project, that must be indicated on the notice. Applicants must also e-mail the neighborhood organizations.

How long does this process?

Applicant must continue to follow the 14-day notice period before hosting any conferencing meeting. This process must conclude before submitting a Project Application.
